Preamble

These General Terms and Conditions of Sale define the rights and obligations of the parties in the frame with the sales made on the online sales website www.lm-maroquinerie.fr. LM Maroquinerie reserves the right to adapt or modify these general terms and conditions of sale at any time. In the event of a change, will be applied to each order the general terms and conditions of sale in force on the day on which the-order is placed was placed. Any order of a Product offered on the site implies the Buyer's acceptance of these general conditions of sale.

1- Identification of the seller and the customer

The parties agree as follows: 
The seller LM Maroquinerie or lm-marquinerie.fr is identified as LM Distribution, a company with a capital of €10,000, and whose registered office is located at 3 rue de pion 40465 Pontonx sur l'Adour, France, It is registered with the RCS of Dax under number 847 511 136, Its intra-community VAT number is FR72847511136. 
The Customer or Buyer on www.lm-maroquinerie.fr must be an adult and a private customer whose purchases are not for commercial purposes.

2- Identification of the customer on the website

The customer who has already made a purchase on the www.lm-maroquinerie.fr website can choose a password allowing him, during subsequent orders, not to have to fill in the forms again. 
The customer already registered is recognized on the site as a www.lm-maroquinerie.fr customer. The password used by the www.lm-maroquinerie.fr customer is strictly confidential and personal. Under no circumstances should it be disclosed or communicated to anyone. 

3- Products

The articles presented on www.lm-maroquinerie.fr are presented while stocks last. When a product is no longer in stock, it is possible to register his e-mail on the page of the product in question, to be notified when it is back online. The descriptions and photos illustrating them are presented with the greatest possible accuracy, however, if errors or omissions are found, www.lm-maroquinerie.fr cannot be held responsible. Photographs illustrating the products in support of the text do not fall within the scope of the contract. All interior, back, side and top views are only photographed in camel color for all our products.

4- Validity of the offer

All orders placed on www.lm-maroquinerie.fr translate the acceptance by the customer of the prices of the products and services offered for sale, as well as these General Terms and Conditions of Sale. Sales prices are presented in Euros, all taxes included, excluding delivery costs if applicable. The VAT of the country of delivery of the order is the one that applies to the amount of the order. 
The prices of the products presented on www.lm-maroquinerie.fr are subject to change. LM Maroquinerie reserves the right to change prices without notice. The prices appearing at the time of purchase are the prices applicable to this purchase.

5- Orders and Data Control

Any order validated on www.lm-maroquinerie.fr before 12h00 (GMT + 1h) from Monday to Friday, will be prepared and shipped the same day. After this time, it will be shipped the next working day. This period of service is however not guaranteed on holidays, and during certain periods (peaks of activity, inventories,...) LM Maroquinerie checks systematically the orders placed on www.lm-maroquinerie.fr. These checks, based on different criteria, may lead our Customer Service Department to contact you, and ask you for additional supporting documents.  Any alleged fraud will be investigated and, if necessary, prosecuted. By submitting your order, you accept these conditions. LM Maroquinerie reserves the right to refuse an order for any reason whatsoever. The brand also reserves the right to cancel any purchase (order already accepted) without being held responsible for any damage or costs incurred, for the following reasons :

  • the product is no longer available
  • your order is identified by our security systems as unusual or likely to be fraudulent
  • we have reason to believe that you are a minor
  • we have reason to believe that you are a reseller
  • we were unable to deliver to the address you provided

6-6- Payment

6.1/ Payment Security
.All banking transactions are secured by the PayPlug payment system (www.payplug.com). All information exchanged to process the payment is encrypted using a SSL protocol. These data can't be detected, intercepted nor used by third parties. They are not stored on our computer systems.  In addition, purchases made on www.lm-maroquinerie.fr comply with the 3D-Secure standard. 3D-Secure is a protocol developed by international issuers Visa (Verified By Visa) and Mastercard (Mastercard Secure Code) to enhance the security of online payments. This protocol is based on the implementation of an additional control during an online purchase : in addition to banking data, the buyer is asked to enter personal data allowing his bank to identify him before validating the payment. Good to know : PayPlug is a technical service provider and does not handle disputes related to orders. These must be solved directly with www.lm-maroquinerie.fr and/or with your bank.


6.2/ Payment methods

7- Intellectual property

All elements of the website www.lm-maroquinerie.fr, whether visual or sound, including the underlying technology, are protected under laws regarding copyright, trademark, patents and right to the image. They are the exclusive property of www.lm-maroquinerie.fr. Any hypertext link linking with www.lm-maroquinerie.fr, using in particular the technique of framing, deep-linking, in-line linking or any other technique of deep link, is illegal. Moreover, any link, even tacitly authorized, will have to be withdrawn on simple request of www.lm-maroquinerie.fr is strictly prohibited. In order to use the elements or information contained on this side, you must have obtained the prior agreement of LM Maroquinerie

8- Customer service

  • by phone: +33 5 59 15 75 32 (call not surcharged) If the products need to be returned to the seller, they must be the subject of a return request from the seller within 14 days after the delivery. Any complaint formulated outside this period cannot be accepted. Returns will be accepted only for products keeps in their original state (packaging, accessories, etc.). Exchanges (subject to availability) and refunds, will be made within 30 days of receipt by the seller of the products returned by the buyer under the conditions provided above.

9- Warranty

All our products benefit from the legal guarantee scheme, provided that the use was normal, and that the care instructions were followed.

Article L211-4 of the Consumer Code
The seller is required to deliver a good in conformity with the contract and is liable for any lack of conformity existing at the time of delivery. 
Article L211-5 of the Consumer Code
To be in conformity with the contract, the good must:

  • 1º Be suitable for the use usually expected of a similar good and, where applicable:
    - correspond to the description given by the seller and possess the qualities that the seller has presented to the buyer in the form of a sample or model;
    - present the qualities that a buyer can legitimately expect in view of public statements made by the seller, the producer or his representative, in particular in advertising or labelling;
  • 2º Or have the characteristics defined by mutual agreement between the parties or be suitable for any special use sought by the buyer, brought to the attention of the seller and accepted by the latter.

The action resulting from the lack of conformity is prescribed after two years from the delivery of the goods. 
Article 1641 of the Civil Code
The seller is bound by the warranty for hidden defects in the thing sold that make it unfit for the use for which it is intended, or that reduce this use so much, that the buyer would not have acquired it, or would have given only a lower price, if he had known them. 
Article 1648 paragraph 1 of the Civil Code
The action resulting from redhibitory defects must be brought by the purchaser within two years of the discovery of the defect.

10- Various stipulations

10.1/ Force majeure
LM Maroquinerie shall not be liable for the total or partial non-performance of its obligations under this contract, if such non-performance is caused by an event constituting force majeure, in particular in the event of a disruption or total or partial strike, in particular of postal services and means of transport and/or communication, flooding or fire. 
The Parties agree to consult each other as soon as possible in order to determine the terms and conditions for processing the order during the duration of the force majeure event. Beyond a period of one month of interruption due to force majeure, the Parties shall be released from their obligations towards each other.
10.2/ The entire contract
These general conditions of sale and the order summary sent to the customer form a contractual package summarizing all the agreements linking the parties. 
10.3/ Transaction retention and archiving
Invoice archiving is performed in a reliable and durable way, in order to preserve a faithful and durable copy. 
10.4/ Applicable law - Competent jurisdiction
These general conditions of sale and the contractual relations between LM Maroquinerie and the customer are subject to French law. In the event of a dispute, exclusive jurisdiction is assigned to the competent French courts.

10.5/ Right of Retractation

In accordance with the provisions of the Consumer Code, the buyer has a period of 14 days from the date of receipt of his order to return any item which does not suit him, and request the exchange or refund of his good without penalty, excepted for the return costs which will borne by him. Returns are to be made in the original state of the products (packaging, accessories,...) allowing their re-marketing as new products, and accompanied by the invoice. Damaged, soiled or incomplete products will not be taken back.
